 Description:  Fraternal Order of Police, Lodge No. 7 and City of Chicago: On August 22, 2013, the Illinois Labor Relations Board's Executive Director, Melissa Mlynski dismissed the unfair labor practice charge filed on April 1, 2013 by the Fraternal Order of Police, Lodge No. 7 (Union or Charging Party) which alleged that the City of Chicago (City or Respondent) violated Sections 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), as amended (Act), when it refused to bargain in good faith over contractual terms and conditions or the collective bargaining agreement to be effective July 1, 2012. The Executive Director reasoned that the charge was untimely filed because the Union had notice on March 27, 2012 of the City's position that the parties' 2007-2012 contract would continue through June 30, 2013. On October 10, 2013, we granted the Union's request for oral argument. For the reasons that follow, we affirm the Executive Director's dismissal.
